Environmental Litigation

Forever Chemicals/PFAS

We represent states and municipalities in lawsuits against 3M, DuPont and Chemours, which manufactured per and poly-fluoroalkyl substances (“PFAS”), also know as “forever chemicals.” 3M and DuPont knew that PFAS are highly toxic substances that do not break down but nonetheless made and sold them in large quantities for decades. The result has been billions of dollars in harm to people and the environment. Our clients in PFAS litigation include the States of Vermont and Maine, the City of Chicago, and other cities.

PCBs

We represent states and municipalities in cases against Monsanto, which manufactured polychlorinated biphenyls (“PCBs”) from the 1930 through the 1970s, when they were banned by the US EPA. Monsanto knew that PCBs were highly toxic but continued to sell them for many years for electrical applications and construction materials such as caulk; Monsanto continued selling them after it became clear that PCBs were a global contaminant.

We represent the States of Vermont and Maine in PCBs lawsuits against the three corporate successors to the original Monsanto Company. The cases seek damages for PCB contamination of the environment. Our case for Vermont and another case for the Burlington (Vermont) School District also seeks the costs of removing PCBs from schools with contaminated construction materials. We also represent Chicago, Evanston and other municipalities in cases seeking environmental damages. We previously represented the State of New Hampshire as well as the City of Los Angeles in PCBs cases that have now been resolved.
