PCB Litigation by Cities and States

Matt, Wes and MacKennan have represented many cities and states in lawsuits against Monsanto Co. to recover for PCB contamination in water bodies and in school buildings.   In more than half a dozen of these cases, Monsanto moved to dismiss these lawsuits; not once did Monsanto succeed.  See, e.g., Burlington Sch. Dist. v. Monsanto Co., No. 2:22-CV-215, 2024 WL 2932902 (D. Vt. June 11, 2024); Maine v. Monsanto Co., No. BCD-CIV-2024-00034, 2024 WL 5202355 (Me. Bus. & Consumer Court, Dec. 16, 2024); Vermont v. Monsanto Co., No. 23-CV-2606, 2024 WL 2818695 (Vt. Super. May 29, 2024); New Jersey Dept. of Environmental Protection v. Monsanto Co., No. GLO-L-000800-22, 2023 WL 9420336 (N.J. Super. L. Aug. 04, 2023); California v. Monsanto Co., No. 22STCV07958, 2022 WL 19226280 (Cal. Super. Nov. 07, 2022).  The same team has also defeated Monsanto’s attempts to remove two of these cases to federal court.  City of Chicago v. Monsanto Co., No. 23-CV-15357, 2024 WL 2138187 (N.D. Ill. Feb. 12, 2024); City of Evanston v. Monsanto Co., 720 F. Supp. 3d 642 (N.D. Ill. 2024).*  To date, Matt, Wes and MacKennan have helped obtain settlements from Monsanto worth $140M.
