Maine Court Rejects 3M and DuPont’s Efforts to Toss Maine Attorney General’s PFAS Case

Pawa Law Group attorneys represent the State of Maine in its lawsuit against the manufacturers of per- and polyfluoroalkyl substances or “PFAS” – commonly known as “forever chemicals” – and PFAS-containing products for statewide contamination of the State’s natural resources and waters with toxic pollution.  The State’s lawsuit alleges that defendants including 3M and DuPont have known for decades that PFAS pose serious risks to people and the environment yet promoted their PFAS-containing products as safe and appropriate for widespread use in Maine.  Toxic contamination stemming from ordinary consumer and industrial use of these products is now a serious problem in Maine.  In a December 12, 2025, Order, a Maine state trial court denied in large part 3M and DuPont’s motions to dismiss the State’s lawsuit.  Matt Pawa argued the motions to dismiss before the Honorable Judge Duddy.  The Court held that the State’s claims for public nuisance, private nuisance, and negligence may proceed and also rejected the defendants’ arguments on injury, causation and standing.  The State’s case is moving forward in state court.
